1. What’s the purpose of this privacy policy?

1.1.      This is the John & Jane privacy policy. You can find our company details in Section 3 below. This policy applies to the processing of your data by John & Jane via our website, which can be found online at https://www.johnandjane.be.

The aim of this policy is to give you transparent information about how your data is used. We recommend that you read it carefully. You can access this policy at any time by going to “Privacy policy” on our website.

2. Who is responsible for the processing of your data via the website?

We are (John & Jane). We are what is referred to in legislation as the “data controller”. What this rather obscure term means is that we determine the purpose for which the data is processed and the way in which it is processed, and we are responsible for the lawful and accurate processing of your data via our website.

4. Which of your data do we process, and how?

4.1.      John & Jane only processes your personal data when you provide that data yourself through the contact details we provide on our website. First and foremost, this may be your identifying data – your surname, first name, address, email address and telephone number, or other personal data that you provide yourself for the purposes specified in Section 5 below.

 

4.2.      Secondly, electronic data may be processed via the website – this includes for example device data, data from log files, IP address, your browser and operating system, any external websites, the pages you visit (and the date and time that you connected to them). 5. Why do we process your data, and what is our basis for the processing?

5.1.      John & Jane processes your personal data for the following purposes:

  • Contact, clarification, information: 
    We process your personal data in order to establish contact with you, to respond to your questions and to provide you with relevant information about our company, our products and services, our website and other information related to our activities. Processing of your personal data for these purposes can be necessary in order to draw up a contract with you, or may be justified by the legitimate interests of John & Jane, providing these override your rights and interests that require data protection. If you do not provide certain data, such as your identification details, we may not be able to respond to your contact request or provide you with a quote, and therefore may not be able to supply our products or services to you
     
  • Direct marketing: 
    Your data can be used for direct marketing. That is, we may use your data to send you information about our products or services, or other information that may be interesting or useful to you, through our newsletter or via other media. If you are one of our clients, we are entitled to do this on the basis of our legitimate interests where they override your rights or interests to data protection. If you are not one of our clients, we need your prior consent to send you this information. You can provide this by e.g. signing up for our newsletter from the website (“Sign up for our newsletter here”). Your consent to this is entirely voluntary and you can withdraw it at any time.
     
  • Optimising the behaviour of our website:
    When you visit or access the John & Jane website, we may process certain electronic data, e.g. cookies, your IP address (see Section 4.1 above). Cookies help to smooth the interaction between you as the user and our website and are used to optimise your user experience and to collect statistics about the users of our website. They are also used to save personal settings and preferences and for delivering visual and audio content. 6. Who collects or processes your data, besides John & Jane?

6.1. Firstly, your data will be processed by our partners, service providers or suppliers with whom we work on our website. These include, for example, our website administrator(s), hosting provider(s) and/or IT partners. These partners will only process your data in relation to your visit to our website and your usage of our website. 

6.2. Your data will be processed by, among others, Google (in connection with Google Analytics and Google Tag Manager) and Hotjar (in connection with the Hotjar service).

  • We use Hotjar to get a better picture of our users’ requirements and to optimise their experience. Hotjar helps us to understand the user experience (e.g., how much time users spend on each page, which links they click, what users do and don’t like, etc.) and we can then optimise our website services based on user feedback. Hotjar uses cookies and other technologies to collect data about user behaviour and devices. This data includes the device IP address (processed during the user session and stored in a depersonalised form), screen size of the device, device type (unique device ID), browser details, geographic location (country level only) and the preferred language used to display our website. Hotjar stores this information on our behalf in a pseudonymised user profile. Hotjar is contractually prohibited from selling any of the data collected on our behalf. 6.3. We are not responsible for how your data is processed by third parties who are not employed by us to process your data, but who do it on their own responsibility.

6.4 John & Jane may be required to provide or process your data on the basis of legal obligations and/or in response to a request for your data from supervisory authorities or official bodies.

7. Is your personal data transmitted outside the EU/EEA?

Your data is not transmitted outside the EU/EEA.

8. How long do we store your data?

We will not store your data for longer than necessary for the purposes described in Section 5 above, unless there are specific legal requirements that apply to retention or processing of your data. Specific statutory retention periods may apply to certain data. In all cases, the same principle applies that we will not store your data for longer than necessary.

9. What are your rights?

9.1. You have the right to information about how your data is processed via our website. This is provided to you in this privacy policy. You can also ask us at any time for additional information by sending an email to hello@johnandjane.be.

9.2. You have the right to request:

  • access to the data we hold about you.
  • You will receive a copy of the requested information, at no cost. For any additional copies you request, we may charge a reasonable fee based on administrative costs.
  • rectification of inaccurate personal data;
  • erasure of your personal data if:
    - processing of this data is no longer necessary in relation to the purpose(s) for which it was being processed by us;
    - you withdraw previously provided consent;
    - you object to the processing by us;
    - the personal data is being unlawfully processed by us;
    - erasure is necessary for compliance with a legal obligation; or
    - the personal data is being processed in relation to online services offered to children;
  • restriction of the processing in relation to you.
  • You have the right to restriction of processing if:
    - you contest the accuracy of the data that we hold about you;
    - the processing is unlawful and you oppose the erasure of the personal data and request the restriction of its use instead;
    - we no longer need the data but you still need the data for the establishment, exercise or defence of a legal claim; or
    - while waiting for a response to the question of whether the legitimate interests of John & Jane override your legitimate interests or rights to data protection if you have objected to the processing on the basis of our legitimate interests.

9.3. You have the right to object to your data being processed.

You can object at any time, and at no cost, to your data being processed for the purpose of direct marketing. This can be done simply by sending us a message to hello@johnandjane.be. You can also do so from the mailings themselves (they always include unsubscribe information at the end). You will then stop receiving newsletters from us.

9.4. You have the right to portability of your data (to another data controller). This right applies only if the processing by us is based on your consent or if the processing is done by automated means.

9.5. If the processing of your personal data is based on your consent, then you have the right to withdraw your consent at any time.

9.7. Exercise of your rights as listed above is always dependent on the requirements and provisions of the applicable law (e.g. the General Data Protection Regulation, GDPR).

9.8. You can exercise your rights by simply sending a request to John & Jane at hello@johnandjane.be. You must provide adequate identification with your request. If we have a reason to doubt your identity, we may ask you for additional information in order to confirm your identity. We will generally ask for a copy of your identity card, in order to verify who is really sending the request.
